The Executive Director, Regulatory and Enterprise Risk Management works with legal and regulatory risk analysis and claims/litigation activities, self-insurance, and excess insurance programs, as well as other related legal and regulatory issues related to the UHealth clinical enterprise. Reporting directly to the UHealth Chief Risk Officer & Patient Safety Officer and Senior Counsel, this position also implements and directs enterprise risk management efforts, including collaboration with executives in risk, compliance, strategy, governance, management, and health care operations, to achieve desired goals and results.CORE JOB FUNCTIONS

  • Serves under the general oversight of the UHealth Chief Risk Officer (CRO) and acts in the CRO's absence with the authority of the CRO to fulfil the responsibilities that fall under the CRO.
  • Works collaboratively with Risk, Legal, Billing and Regulatory Compliance, Accreditation, and Regulatory Affairs leadership to comply with state and national norms of legal and regulatory health care compliance.
  • Leads and leverages cross-functional teams to develop solutions through partnership with key business resources in the support of risk mitigation strategies, identification, quantification, and management of risks.
  • Participate in UHealth leadership meetings and develop a collaborative relationship throughout the organization to leverage resources to advance risk prevention and claims and litigation/professional liability lessons-learned programs.
  • Recommends appropriate revisions to new or existing policies, procedures, and forms to reduce the frequency of future occurrences; recommends ways to minimize risks through system changes; reviews and revises facility policies, bylaws, rules and regulations as appropriate to maintain adherence to current standards and requirements.
  • Evaluates regulatory compliance concerns and makes recommendations for improvement to ensure that safety/regulatory recommendations are implemented in accordance with accreditation standards and guidelines.
  • Ensures compliance with state and federal laws, government regulations, accreditation requirements, and UHealth policies.
  • Ensures internal control oversight and compliance with laws and regulations, safeguarding of assets, compliance with University policies and procedures, reliability of internal and external reporting, and efficiency and effectiveness of operations. -
  • Creates an effective control environment, conducts risk assessment, implements, and monitors controls.
  • Remains informed regarding emerging threats to ensure that risks are well known and understood.

    • Juris Doctor degree
    • Florida Bar License or Authorized House Counsel

      • Must possess strong leadership skills and be an effective facilitatorDEPARTMENT ADDENDUMDepartment Specific FunctionsCooperates with the staff of the Chief Medical Officer(s), Quality Officer(s), Chief Compliance Officer and Enterprise Risk Management teams in the development of interrelated programs and the development of shared staff resources for coverage of primary and satellite facilities and implement cross-training and education for their staff regarding the interplay of medical enterprise risk management, healthcare law and regulation risk, and compliance principles and programs. Establish event investigation and reporting criteria and supervise the overall investigative process, including assuring appropriate documentation systems/tools, procedures, and a comprehensive corrective action process. Collaboration with senior medical leadership and human resources staff to design and implement prompt clinical education and training intended to use lessons learned from grievance, risk, quality, claims and litigation investigation to effectuate real-time systemic adjustments. Collaboration with departmental and hospital personnel regarding the development of appropriate processes for confidential and effective medical case review, peer review, and potential claims review. Collaboration with Executive Director of Medical Risk Management and with the Executive Director of Patient Safety in establishing effective risk management and patient safety programs in all functional areas of the health care organization. Collaboration with Executive Director of Claims and Litigation and keep claims and risk professionals up to date on emerging issues and trends relating to health law, insurance coverage, and related litigation. Works collaboratively with Legal, Billing and Regulatory Compliance, Accreditation, and Regulatory Affairs leadership to comply with state and national norms of legal and regulatory health care compliance. Assists risk management and claims and litigation personnel to partner effectively with patient safety and quality staff to effect UHealth patient safety and quality goals and programs. Assist risk management personnel to interact and collaborate effectively with the UHealth Patient Experience and Patient Access personnel in extending risk prevention, claims reduction, and prompt resolution strategies to all aspects of the patient care process. Informs directors of service and department heads regarding occurrences, issues, findings, and risk management suggestions; provides feedback to directors at all levels in the effort to eliminate risks; assists clinical chairs and department heads in designing risk prevention programs within their departments. Provides consultative guidance and advice to hospital and medical staff leadership. Works in close alignment with internal patient safety, patient experience, clinical quality excellence, compliance, legal services, and treasury and finance departments. Stays up-to-date on changes in law and legal climate. Inform UHealth leadership and medical staff of legislative updates and new statutes/guidelines. Develop rapport and trust with physicians, nurses, other clinical staff, patients and families. Partner effectively with other leaders to assess and proactively manage risk profiles/requirements of the federal acts/regulations affecting the health system through policy development, guidance, or education, such as: Americans with Disabilities Act (ADA), Centers for Medicare and Medicaid Services (CMS) Regulations; Office of Inspector General (OIG) audits, guidelines, and advisory opinions; Emergency Medical Treatment and Active Labor Act (EMTALA/COBRA), Food and Drug Administration (FDA), Health and Human Services (HHS), Health Care Quality Improvement Act (HCQIA), Health Insurance Portability and Accountability Act (HIPAA), Health Resources and Services Administration (HRSA), National Practitioner Data Bank (NPDB), Occupational Safety and Health Administration (OSHA), Patient Self-Determination Act (PSDA), Safe Medical Device Act (SMDA), Fraud and Abuse Legislation and Regulation; Sunshine Act Disclosures and Conflict of Interest guidelines. Promote compliance with ERM related legislation and regulation through policy development, guidance, or education. Promote compliance with state and federal reporting requirements through policy development, guidance, or education. Develops statistical and qualitative medical enterprise risk management reports. Ensure public health processes and programs are in place (e.g., Advance Directives, cultural sensitivity, organ donation). Assist in the development of responses to inquiries from regulatory and licensing agencies. Available during off-hours to respond to urgent events.
